a. Keep your DUI ticket!
However, during the first ten (10) days of your arrest,
you are legally permitted to drive by virtue of your
DUI ticket. Your DUI ticket serves as a temporary driver’s
license; so keep it with you. Therefore, it is very important
that you SAVE YOUR DUI TICKET. *Note that you are only
permitted to drive with your DUI ticket for 10 days if
your license was valid at the time of your arrest for
DUI.
b. What you MUST do within 10
days of your arrest!
During the ten (10) day period following your arrest,
you MUST submit an application for a
Formal Review to the Board of Administrative Reviews,
Formal Review Section in order to obtain up to an additional
forty-five (45) day extension to drive while your D.U.I.
is pending . In submitting an application, you are in
essence are asking for a hearing to challenge the suspension
of your driver’s license by the Department of Motor
Vehicles.
Go to the section entitled “Apply for your 10 day
hearing” to fill out an application for a formal
review hearing.
Your ten (10) days start the day after your
arrest and include holidays, Saturdays and Sundays. (Example:
If you were arrested on March 1st, your ten (10) days
expires on March 11th. March 11th is the last day you
can drive on this ten (10) day extension afforded by
your D.U.I. ticket.)
c. How Do I Submit my Application?
You may submit your Formal Review Application AND a
copy of your D.U.I. ticket in one of three ways:

How do I know if My Application is Timely?
- If you faxed your application & ticket – the
fax confirmation you received showing that the Board
of Administrative Reviews received your faxed application
serves as proof you complied within ten (10) days.
So long as you fax it before the end of the business
day on the tenth day, you are ok.
- If you mailed your application – the date your
envelope was post-marked by the Post Office serves
as the date you complied within the ten (10) day period.
If it is the 10th day and you are intend to mail your
application today – GO TO THE POST OFFICE and
make sure it is date stamped with the date. DO NOT
HAND IT TO THE MAILMAN. (*IMPORTANT: the Oakland Park
Post Office @ 1900 W. Oakland Park Blvd., postmarks
mail every day, including Saturday and Sunday.)
e. What Happens After I Submit
My Application?
Once your application is approved, you should be given
a white business purpose license that further extends
your right to drive for up to an additional forty-five
(45) days while your D.U.I. charge is pending. Your white
business purpose license will indicate the number of
days you are permitted to drive.
(*IMPORTANT: If you fail to submit your application within
ten (10) days of the date of your arrest, you will lose
your right to set aside the suspension. Also, if your
license was previously suspended for another reason,
you will not be given this extension.)
f. What Happens if I win
My Formal Hearing?
You will get your driver’s license back.
g. What happens if I do not win
my Formal Hearing?
You have the opportunity to appeal the decision. If
you choose not to appeal, you will not have a driver’s
license for a period of thirty (30) days.
At the end of this thirty (30) day period you will be
eligible for a hardship license for the remainder of
your six (6) month driver’s license suspension
(assuming again, your license has not been suspended
for some other reason.)
